Please read these Terms of Use carefully as it is legally binding agreement between you, your heirs and representatives (collectively, “you”, “user”, “Customer”) and Aarshi Fashions^® (together with all its owners, affiliates and subsidiaries, referred here as “we”, “our”, or “us”). These Terms of Use along with the Privacy Policy extends to users who visits the Site but do not transact business on the Site (“Users”) as well as users who are registered and are authorized by the Site to transact business on the Site (“Members”). Your order for purchase constitutes your “offer” which shall be subject to the terms and conditions as listed below. Aarshi Fashions^® reserves the right to accept or reject your offer. If you have supplied us with your valid email address, we will notify you by email as soon as possible to confirm receipt of your order and email you again to confirm details and therefore process the order. Our acceptance of your order will take place upon dispatch of the product(s) ordered. No act or omission of Aarshi Fashions^® prior to the actual dispatch of the product(s) ordered will constitute acceptance of your offer.

Eligibility

Use of the Site is available only to persons who can form legally binding contracts under applicable law. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Site. If you are a minor i.e. under the age of 18 years but at least 13 years of age, you may use this Site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. If your age is below that of 18 years your parents or legal guardians can transact on behalf of you if they are registered users. You are prohibited from purchasing any material which is for adult consumption, the sale or purchase of which to/by minors are strictly prohibited.

Aarshi Fashions^® reserves the right to terminate your membership and refuse to provide you with access to the Site if Aarshi Fashions^® discovers that you are under the age of 18 years. The Site is not available to persons whose membership has been suspended or terminated by Aarshi Fashions^® for any reason whatsoever. If you are registering as a business entity, you represent that you have the authority to bind the entity to the Terms of Use.

Except where additional terms and conditions are provided which are product specific, these terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms of any order submitted.

Account and Registration Obligations

“Your Information” is defined as any information you provide to us in the registration, buying or listing process, in the feedback area or through any email feature. We will protect Your Information in accordance with our Privacy Policy. If you use the Site, you are responsible for maintaining the confidentiality of Your Account and Password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under Your Account or Password. Aarshi Fashions^® shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account. If you know or suspect that someone else knows your password, you should notify us by contacting us immediately through the address provided below. If Aarshi Fashions^® has reason to believe that there is likely to be a breach of security or misuse of the Aarshi Fashions^® Site, we may require you to change your password or we may suspend your account without any liability to Aarshi Fashions^®.

Pricing Information

While Aarshi Fashions^® strives to provide accurate product and pricing information, pricing or typographical errors may occur. Aarshi Fashions^® cannot confirm the price of a product until after you order. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, Aarshi Fashions^® shall have the right, at our sole discretion, to refuse or cancel any orders placed for that product, unless the product has already been dispatched. In the event that an item is mis-priced, Aarshi Fashions^® may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Unless the product ordered by you has been dispatched, your offer will not be deemed accepted and Aarshi Fashions^® will have the right to modify the price of the product and contact you for further instructions using the e-mail address provided by you during the time of registration, or cancel the order and notify you of such cancellation. In the event that Aarshi Fashions^® accepts your order the same shall be debited to your credit card account and duly notified to you by email that the payment has been processed. The payment may be processed prior to Aarshi Fashions^® dispatch of the product that you have ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit card account.

We strive to provide you with the best prices. However, sometimes a price online does not match the price in a store. In our effort to be the lowest price provider in your particular geographic region, store pricing may sometimes differ from online prices. Prices and availability are subject to change without notice.

Shipping Policy

Unlike many other e-commerce websites that have special rules and lots of fine print, Aarshi Fashions^® has a transparent and clear shipping policy for all orders placed on our Site, without any special exceptions.

Before placing an order, we always advise our customers to go through the description of the product thoroughly on the product page.

Aarshi Fashions^® offers to provide FREE shipping on every order without any monetary limit for most of the locations within India. For certain inaccessible and / or locations requiring special arrangement to ship the products within India or outside India, the actual shipping charge by the courier company will be charged. Our sales team will contact the customer to inform if shipping charges are applicable.

We urge all customers to inspect the package for any damage or tamper before receiving or signing for receipt.

After your order (s) has been successfully placed, booked and packaged, it will be shipped within 24-48 working hours by a reputed courier service provider. The expected time frame for the delivery of the booked products to the shipping address is between 3-7 working days.

However, during high volume orders i.e. during the festive season and Aarshi Fashions^® Stock Sales, the orders shall be delivered within 10- 12 working days.

Delivery of products is not attempted on Sundays or public holidays.

Please note all the items will be shipped with an invoice mentioning the price, as per Indian Tax Regulations.

Depending on the product(s) you purchase on the Site and the location to which the products will be delivered, different shipping methods will be available. Each shipping method has its own restrictions and charges that will be applied to your order.

The lead time for shipping the product will be counted from the day the order will get processed. This is because, sometimes, our order processing team may need to make verification with the customer who has placed the order generally in case of COD orders. There is a chance that when our customer support team may call you, and you may not be available and our team drops an email to you. Till we receive a reply from you or till the verification is completed, a particular time has already passed. That time will not be counted under the lead time. Only when the order gets processed and the verification is completed, the lead time will be start.

Order

Before confirmation of any order(s) placed, Aarshi Fashions^® may contact you through the Site and ask you a verification question and the order shall be confirmed only after the verification question is answered by the customer, generally in case of COD orders.

Once the purchase of the item(s) is confirmed by you, Aarshi Fashions^® will arrange to pack and deliver the product to you.

In case the option of payment selected at the time of making/ opting to pay is by electronic means be it Debit Card / Credit Card / Net- Banking, all the orders are considered complete only after the payment has been received by Aarshi Fashions^® and receipt of payment has been confirmed.

In case, you opt to make the payment on Cash-on-delivery basis, the orders shall stand completed once the cash payment has been received by the delivery person and the product/ article ordered is handed over to you and a receiving has been signed by the you or anybody on his/ her behalf.

Product Availability

Due to slow connectivity of Internet, failure in processing of the order due to any technical default, etc. there may be possibilities that the item selected and put in the cart is not available anymore as the same might have been sold to other customer. Such situation occurs in cases of shortage of products/ articles of a particular range/ quality/ price discount offered/ or high demand at that point of time.

In such an event, Aarshi Fashions^® will call the Customer (provided he is a registered user on the Site) and suggest an alternate product. In case the Customer chooses a different product, Aarshi Fashions^® shall confirm the new order. If the cost of the new selection is more expensive than the previous one, the Customer shall have to pay the differential amount. If the cost of the new selection is less expensive than the previous one, Aarshi Fashions^® shall refund the excess amount to the Customer in the manner specified below in this Terms of Use. Instead of making a replacement in such a way, we can request the customer to return the product and place a fresh order.

Cancellation by Aarshi Fashions^®

Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is cancelled after your credit card has been charged, the said amount will be reversed back in your Card Account.

Return Policy

Any order(s) once placed cannot be cancelled under any circumstances.

A customer may exchange/ return the product only within 7 days from the date of receipt of the product. To return the product, the customer shall use the return option available on the Site after logging into its account. Upon receipt of the exchange/return request, we will arrange for the pick-up of the product from the customer through our partnered courier service provider. However, the customer will have to bear the actual courier charges (normally Rs. 150) for exchange/ return of the product from the customer’s location to Aarshi Fashions^®. Such courier charges will be deducted from the refund amount payable to the customer.

The product should be undamaged, unused, unwashed, unsoiled, without any stains and with non-tampered quality check seals/ company seals (wherever applicable). We shall refund the amount only after we receive the product back and the quality check has been done for the same. In case, the product received back is not in the original condition, then no refund will be made to the customer.

Refunds

Any refunds due by Aarshi Fashions^® to the Customer shall be made in the following manner:

Credit card: The credit card account of the Customer will be re-credited with the refund amount by Aarshi Fashions^® without any charge on the Credit Card. The refund amount will be credited to the Customer’s account within the time span stipulated by the bank which has issued the credit card; or
Net Banking/ Wire transfer: The refund amount shall be deposited into the bank account of the Customer by Aarshi Fashions^® within ten (10) business days after the receipt of request for refund by the Customer has been approved.

* Note: If you do not receive a credit within this time, please check with your bank and let us know if you face any issues with the same.

Credit Card Details

You agree, understand and confirm that the credit card details provided by you for availing of services on Aarshi Fashions^® will be correct and accurate and you shall not use the credit card which is not lawfully owned by you, i.e. in a credit card transaction, you must use your own credit card. You further agree and undertake to provide the correct and valid credit card details when making payment on Aarshi Fashions^®. Your credit card information never reaches Aarshi Fashions^®, we just get pass, hold or fail message from our payment gateways. The said information will not be utilised and shared by our payment gateways or Aarshi Fashions^® with any of the third parties unless required for fraud verifications or by law, regulation or court order. Aarshi Fashions^® will not be liable for any credit card fraud. The liability for use of a card fraudulently will be on you and the onus to ‘prove otherwise’ shall be exclusively on you.

Fraudulent /Declined Transactions

Aarshi Fashions^® reserves the right to recover the cost of goods, collection charges and lawyers fees from persons using the Site fraudulently. Aarshi Fashions^® reserves the right to initiate legal proceedings against such persons for fraudulent use of the Site and any other unlawful acts or acts or omissions in breach of these terms and conditions.

We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any transaction, on account of the cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.

Electronic Communications

When you visit the Site or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

You Agree and Confirm

That in the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address or any other wrong information) any extra cost incurred by Aarshi Fashions^® for redelivery shall be claimed from you.
That you will use the services provided by Aarshi Fashions^®, its affiliates and contracted companies, for lawful purposes only and comply with all applicable laws and regulations while using the Site and transacting on the Site.
You will provide authentic and true information in all instances where such information is requested of you. Aarshi Fashions^® reserves the right to confirm and validate the information and other details provided by you at any point of time. If upon confirmation your details are found not to be true (wholly or partly), Aarshi Fashions^® has the right in its sole discretion to reject the registration and debar you from using the Services of Aarshi Fashions^® and / or other affiliated websites without prior intimation whatsoever.
That you are accessing the services available on this Site and transacting at your sole risk and are using your best and prudent judgment before entering into any transaction through this Site.
That the address at which delivery of the product ordered by you is to be made will be correct and proper in all respects.
That before placing an order you will check the product description carefully. By placing an order for a product you agree to be bound by the conditions of sale included in the item’s description.

Governing Law and Jurisdiction

The Terms of Use shall be construed in accord with the applicable laws of India. The Courts at Mumbai shall have exclusive jurisdiction in any proceedings arising out of this agreement.

Any dispute or difference either in interpretation or otherwise, of any terms of the Terms of Use between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by Aarshi Fashions^® and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended time to time. The arbitration shall be held in Mumbai. The competent courts at Mumbai alone shall have the jurisdiction relating to any action, suit, or other legal proceeding arising under or relating to these Terms of Use.

Reviews, Feedback, Submissions

All reviews, comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to Aarshi Fashions^® on or by this Site or otherwise disclosed, submitted or offered in connection with your use of this Site (collectively, the “Comments”) shall be and remain Aarshi Fashions^® property. Such disclosure, submission or offer of any Comments shall constitute an assignment to Aarshi Fashions^® of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments.
